Terms of service
These terms cover the hosted service at app.closeyour.it. The open-source code you install on your own server follows its licences instead: the server is AGPL-3.0, the SDKs and the CLI are MIT. A self-hosted install is run by whoever installs it, under their own responsibility.
Who provides the service
The service is provided by Alessio Bussolari, Via del Prete 121, 47841 Cattolica (RN), Italy, VAT no. 02037590383. For any question about these terms write to [email protected].
What the service is
CloseYourIt brings project management, error and log monitoring, secrets, infrastructure, customer service, analytics and a knowledge base into one place. The hosted service is the same open-source software, run by us on our servers.
Price
The hosted service is free of charge. There are no paid plans and no payment is taken, so nothing renews or is billed. If we ever introduce paid features, we will publish the price, renewal and cancellation terms first, and nothing will be charged without your explicit agreement.
Access and accounts
- Access to the hosted service is on request. We may accept or decline a request.
- Give true details and keep them up to date.
- Keep your password and keys to yourself. You are responsible for what happens in your account and for the people you invite into your organisation.
- Tell us straight away if you think someone used your account without permission.
Acceptable use
- Use the service only for lawful purposes.
- Do not upload content that breaks the law or the rights of others, and do not upload malicious code.
- Do not try to get around limits, reach data that is not yours, or test the security of the service without our written permission.
- Do not overload the service on purpose and do not resell it without our agreement.
- Put other people's personal data in the service only when you have the right to do so.
Your content
What you put in the service stays yours: tickets, comments, files, logs, secrets and everything else. You give us only the limited licence we need to store, process and show it so we can run the service for you. We do not use it for anything else. When your content contains personal data, we process it on your behalf, as the privacy notice explains.
CloseYourIt AI
The AI features are optional and stay off until you turn them on. With a CloseYourIt AI key, requests run on our servers within the monthly limit of the key, and we keep only how much was used, never the text. With your own provider, that provider's terms apply. AI answers can be wrong: check them before you act on them.
Availability
We provide the service as it is and as available. We work to keep it running and your data safe, but we do not guarantee any uptime: the service may stop for maintenance, faults or changes. Keep your own copy of what matters to you.
Liability
We are liable within the limits the law allows. We are not liable for indirect losses, such as lost profits, unless the law says otherwise. These limits never apply to wilful misconduct or gross negligence, and they never reduce the rights a consumer has by law.
Suspension and closing
- You can close your account at any time by writing to [email protected].
- We can suspend or close an account that breaks these terms, puts the service or other users at risk, or that the law requires us to stop. When we can, we warn you first.
- We can stop the hosted service altogether. In that case we tell you at least 30 days in advance, so you can export your data.
- After closing, we delete or anonymise your data as the privacy notice describes.
Right of withdrawal
If you are a consumer, you can withdraw from these terms within 14 days of the day your account is activated, without giving a reason, by writing to [email protected] (articles 52 to 59 of the Italian Consumer Code). Since the service is free, there is nothing to refund: we close the account and delete your data as the privacy notice describes.
Changes to these terms
We may change these terms. We update the date at the top and, for significant changes, we tell you inside the product or by email at least 15 days before they apply. If you do not agree, you can close your account before then.
Law and courts
These terms are governed by Italian law. If you are a consumer, the court of the place where you live has jurisdiction. In every other case the court of Rimini has exclusive jurisdiction.
